Surveillance
Corporate surveillance is a term that is used to describe any type of discreet monitoring of activities within a business or within the industry associated with that business. When this type of surveillance is utilized internally, the goal is usually to protect the interests of the company. This is done by using various forms of employee monitoring to make sure all policies and procedures are being followed, and that employees are conducting themselves and their use of company property in a manner that is considered ethical and legal. In situations that relate to monitoring the activities of major competitors, corporate surveillance will typically involve monitoring media outlets as well as using technology to stay abreast of any information in the public domain that relates to those competitors.
In businesses where security is extremely important, corporate surveillance may also involve the use of equipment that monitors movements through company operated facilities. This can make it possible to determine when an employee enters a restricted area and take action to correct the potential breach in security. This type of business protection is not uncommon among corporations that handle sensitive data that is only made available to employees on a need-to-know basis.
As a tool for remaining in tune with what is happening in the industry, corporate surveillance may involve monitoring the activities of direct competitors. Here, the surveillance may take the form of using software that immediately locates any new information released online that has anything to do with competitors. Engaging in this type of corporate surveillance can often provide companies with data that makes it possible to maintain market share by developing new ways to counter the efforts of the competition.

Pre-transaction/ Pre-employment
Fraudulent misrepresentation is considered active fraud and is the most serious. Fraudulent misrepresentation is not only misrepresenting a detail about a transaction, but doing so purposefully in order to deceive another party.
Six conditions must be met for fraud to be present. They are:
- An individual must make a false representation
- The misrepresentation is material to the transaction
- The misrepresentation is made with knowledge of its falsity or disregard as to its truthfulness
- The misrepresentation is made with the intention of inducing action or lack of action from the other party
- The other party relies on the lie to make their decision
- The lie must proximately cause the other party to suffer damages
Fraudulent Misrepresentation is a civil offense and the immediate remedy in civil court for misrepresentation is rescission. The court will act as if the contract or transaction never existed. It is important to note that the defrauded victim must act promptly! In addition the court can allow damages for losses suffered because of the lie.
Fraudulent misrepresentation is the most difficult type of misrepresentation to prove because of the need to demonstrate intent.
The way to avoid being victimized by fraudulent misrepresentation is through due diligence. Due diligence is an investigation of a business or person prior to signing a contract, or an act with a certain standard of care. It can be a legal obligation, but the term will more commonly apply to voluntary investigations.
A common example of due diligence in various industries is the process through which a potential acquirer evaluates a target company or its assets for an acquisition. The theory behind due diligence holds that performing this type of investigation contributes significantly to informed decision making by enhancing the amount and quality of information available to decision makers.
The risks inherent in today’s financial transactions are greater than ever. The Ingenium Consulting Group provides answers to questions that financial and legal analyses cannot address, especially regarding integrity issues and the reputations and backgrounds of counterparties and potential employees.
We tailor our investigative due diligence to each client and their specific needs, and our work entails a thorough review and analysis of public records and inquiries of human sources. Ingenium does not rely on databases and computer-based sources alone. These sources are often incomplete or updated only sporadically. As such, Ingenium conducts onsite research and analyzes this information to identify risks.
Pre-employment and Screening
One of the biggest expenses and most time consuming functions for any employer is the screening and hiring of prospective employees. The need to adequately screen your applicants is essential. Many applications contain misrepresentations about the applicant’s education, employment, or criminal records.
Public Records Reviewed
The term “public records” is an umbrella term that covers a vast number of records that are, for the most part, public information.
Common examples of public records include:
- Corporate Records
- Business Registration
- Birth and death certificates
- Marriage licenses and certificates and divorce decrees
- Deeds, mortgages, and other related property records
- Various licenses, including professional and business licenses
- Driving records
- Criminal records including wants and warrants
- Sex offender records
- Court records
- Unclaimed property
- Missing persons
- Voter registration and election records

Interviews and Interrogations
Typically, investigators have only one single opportunity to conduct a proper and effective witness or suspect interview. If this event becomes a missed opportunity, valuable information may be lost forever and otherwise successful cases may go awry.
One of the most critical stages of many investigations, both in the private and police sector is the subject’s interview and interrogation. Many cases are won or lost on the basis of this critical stage of investigation.
With our ongoing training and years of interview techniques we are confident in uncovering the true facts of the matter. We can compile evidence through the words an individual provides during a statement either verbal, non-verbal or written responses in addition to the tone and manner in which they speak. Their reaction to questions and the physical characteristics in how they present themselves provides critical details to follow up on. Our interviews may be recorded on audio tape or videotape upon your request. You have the right to know the truth!
